Can I use a General Affidavit for a Construction Tender?
No. You MUST use the specific Construction Sector Code affidavit. Using a general DTI affidavit for a construction tender will lead to disqualification or zero points for B-BBEE.
Does a Sworn Affidavit need to be certified?
Yes. It must be signed by a Commissioner of Oaths (e.g., at a police station, bank, or post office). The date of the commissioner's stamp must match the date you signed it. It is valid for 12 months from that date.
What B-BBEE level is an EME with 100% Black ownership?
An Exempted Micro Enterprise (EME) with 100% Black ownership is automatically rated as B-BBEE Level 1, which earns the maximum 20 preference points under the 80/20 system. An EME with at least 51% Black ownership qualifies as Level 2.
What is the difference between 80/20 and 90/10 preference points?
The 80/20 system applies to tenders below R50 million where 80 points are for price and 20 for B-BBEE. The 90/10 system applies to tenders above R50 million where 90 points are for price and 10 for B-BBEE. Level 1 gets full points in both systems.
How long is a B-BBEE certificate valid?
A SANAS-accredited B-BBEE verification certificate is valid for 12 months from the date of issue. A sworn affidavit for EMEs and qualifying QSEs is also valid for 12 months from the date of the Commissioner of Oaths stamp.
